Real Estate & Land Acquisition

The real estate sector is highly competitive and rapidly changing. Vedanta Legal® focuses on advising clients across varied transactions in the real estate spectrum. We represent real estate funds, developers, lenders, investors, societies/condominiums and other business users on all aspects of real estate transactions including acquisition of land, through private purchase or a statutory land acquisition process, title searches and drafting of conveyances, development agreements for residential and commercial developments, leases and related documents, sale and lease-back arrangements of commercial/industrial property including advice on applicable stamp duties and registration process and securitization arrangements.

We also assist in structuring the investments in properties in India including formation and structuring of Real Estate funds.

Broadly, our scope of work in Real Estate includes:

  • Drafting lease deeds, leave and license agreements, facility use agreements, sale deeds, escrow agreements, project management, service and maintenance contracts.
  • Advising on compliances under the Real Estate (Regulation and Development) Act, 2016. Drafting, reviewing and negotiating of joint venture agreements, investment agreements, shareholders agreements, collaboration agreements for real estate projects.
  • Conducting title diligence of underlying properties and land pan India followed by issuing of due diligence reports.
  • Conducting statutory compliance audits on properties pertaining to applicable law, charges, encumbrances and litigation history.
  • Assisting in registration of properties.
